Section 8
Investigation of Immigration Offenses

(1) Any offense committed or intended to be committed, directly or indirectly, against this Act and the rules made under this Act If the department or office comes to know about the crime, the immigration officer designated by the director general will investigate and prosecute the related crime.

(2) Arresting the person involved in the crime during the investigation of the crime as per sub-section (1) or while collecting evidence, searching any place related to the crime. The immigration officer will have all the same powers as the police have, according to the prevailing law, to seize, take custody of crime-related documents or other goods, and prepare warrants. During such investigation, the police officer may ask the accused to make a statement and, if there are reasonable grounds, keep him in custody, release him on bail or take bail or keep him in custody for up to twenty-five days with the permission of the court. But as soon as the immigration officer starts investigating the crime, he must inform the Director General. (2A) If the accused who is required to give bail or surety according to sub-section (2) fails to give bail or surety, he can be detained. .
